Transposition letter

The reason for writing a letter are two-fold.
-
Firstly, we create a resource that organisations in the community
can use if the transposition in their respective member
state risks having
an unusable exclusion. It enables an organisation to move
fast when sending
a letter with numerous signatories.

Secondly, there are many member states whose FOSS organisations
are not part of the community list. There are potentially
dark regulatory
clouds on the horizon, and we should spend energy now to identify and
engage with organisations across the EU. To do this, add proposed

Excluding all of software from the scope:

We discussed a push for a broader exclusion of software as a whole.
Regarding this, OFE is concerned that we would stray beyond our key
message, and the focused approach that was key to our results.

We will stay on message for this letter.

However, while OFE has throughout the process opted for a careful
approach, we are of course not opposed to the idea of a broader software
exclusion. We believe that if an organisation in a member state
feels that
there is a reasonable chance to get a broader exclusion, they
should argue
for it. This will be informed by the organisations relationship with the
government in question, which they will know better than OFE.
Process for the letter
The strategy agreed on is relatively straight forward but will depend on
the buy in from the community.

First phase: Drafting
-
Drafting the letter (OFE). We aim to do within two weeks.

Second phase: Edits and finalization

All: 1-2 Weeks of input from the Community to the letter. We are a
lot of people on this list now, so try to be as clear and
constructive as
possible with your feedback.

OFE to finalize the letter.

Third phase: Signatories

As the letter will stay on the same message as our last letter to
the member states before the trilogues, OFE will ask earlier
signatories to opt-out
of signing.

Inviting more organisations to sign.

Fourth phase:

Translations: An organisation in each MS will be in charge of this

Sending it: An organisation in each MS will be in charge of this
Sending the letter
In some member states, it might be most expeditious to "let sleeping dogs
lie". OFE does not believe that there is a need for a massive send out to
all EU governments right now. We consider this letter is a resource for
if/when there is movement in a member state. Instead of then scrambling to
get an effort together, we will be prepared.
We advise all organisations to work to build lasting relationships with
government officials. We trust your judgment in terms of timing etc.

states. *We highly encourage you to participate in this call to get an
update on the process, but also because we need your help to identify and
reach out to organisations that are present in member states that are
currently not represented on this list.* This, in itself, is a useful
process in terms of strengthening our ability to mobilize.
