MySQL can be forked. Monty may well believe that a fork wouldn’t be

Oracle – it was a listed company and could have been the subject of a
hostile takeover.
Finally, I hate to say it but Monty and a lot of these Open Source
zealots are deluding themselves. Oracle did not buy Sun for MySQL.
Oracle did not buy Sun for the hardware division. Oracle bought Sun for
Java.
